The Senate on Wednesday, 21 October, as the decision-making chamber, adopted the bill on designated establishments and the appointment of legal representatives for obtaining electronic evidence in criminal proceedings. This is a parliamentary adoption, not promulgation and not entry into force.

The bill, initiated by the Government, transposes Directive (EU) 2023/1544. Electronic service providers that operate in the Union must designate an establishment or a legal representative in the EU, responsible for receiving and executing orders issued by competent authorities for electronic evidence. It is not the law implementing Regulation (EU) 2023/1543, a different file.

The text, quoted by Digi24, says that providers who choose a designated establishment or a representative on Romanian territory notify ANCOM, accurately and in full. It applies to those who offer services in Romania or in other member states, except those who operate exclusively in Romania.

The National Authority for Management and Regulation in Communications is given the role of central authority and coordinates cooperation with similar institutions in the other member states. That role starts when the law is in force, not on the day of the plenary vote.

Providers who already offer services on the date of entry into force have six months to designate establishments or legal representatives. The clock runs from publication and entry into force, not from 21 October. Digi24 writes that, to enter into force, the law must be promulgated and published in the Official Gazette.

On the Senate agenda the initiative appears as L568/2026, an organic law, first adopted tacitly by the Chamber of Deputies. Today’s plenary voted the bill; it did not sign a decree and it did not open an ANCOM register. An adoption, not a promulgation.
